Contractor sues Manufacturers of Dump Truck and its components for injuries

Los Angeles, California, May 22, 2007 - According to the lawsuit, the injured contractor was planning on loading supplies into a building material supply yard. The manager of the yard allowed the contractor to use an old and rarely used truck, at the yard, in transporting the purchases.
Consequently, the yard's manager gave orders to a helper to help out the contractor. Since the truck was in a position wherein its dump body was raised, the helper was told to move the truck's position in order to load materials.
Following the yard man's orders, the helper started the engine and used the controls located in a small center of the truck cab's console of the truck cab attempting to lower the dumper. In the controls, one knob held the pump into the power takeoff of the transmission. Another knob is used for the hydraulic lifting and lowering system. However, after several tries of pushing and pulling the knob for lifting the dumper, there were no changes in the dumper's position.
The contractor then told the helper to disengage the hydraulic pump but got a complaint that the knob seemed stiff because it was not easy to move. Thus, the contractor went to take a look at the truck's lift valve and also its cylinder, thus ordering the helper to let go of the controls.
Unfortunately, when the contractor was leaning under the hoisted dumper, it suddenly lowered. The involuntary action of the truck caused the contractor's head to be trapped against the frame. If not for some lumber that covered the truck frame rails and prevented the dumper from completely lowering, the contractor would have died.
However, the injuries he had sustained were still serious, as he needed reconstructive surgery to repair one of his eye sockets. He also underwent a major cosmetic surgery and massive dental repairs.
According to the conclusions drawn by an investigator, the improper installation or maintenance of the equipment along with careless and incorrect use was the main factors that caused the accident.
