Court Certifies 118,000 Member Class in Case Filed Against

Press Release Summary = Today, a judge of the Los Angeles Superior Court certified a class of approximately 118,000 members in a lawsuit bought by Joanne Kay Ward and others against Albertsons, Inc., Lucky Stores, Inc. (since merged into Albertsons) and Sav-on Drug Stores for plaintiffs’ claim that the three companies routinely fail to pay terminating employees in a timely fashion as required by California law.

Press Release Body = LOS ANGELES (Jan. 4, 2005) - This morning, the Los Angeles Superior Court (Hon. Morris B. Jones, Judge) certified a class of approximately 118,000 members in a lawsuit bought by Joanne Kay Ward and others against Albertsons, Inc., Lucky Stores, Inc. (since merged into Albertsons) and Sav-on Drug Stores. The lawsuit arises out of plaintiffs’ claim that the three companies, now all part of Albertsons, Inc., routinely fail to pay terminating employees in a
timely fashion as required by California law. Plaintiffs seek so-called waiting time penalties (one day of pay for every day of delay, up to a maximum of 30 days’ pay) for the violations. With the class certification, plaintiffs will now be able to seek such penalties on behalf of the entire 118,000 member class whose employment at one of these chains terminated on or after September 29, 1996.

Plaintiffs are represented in the lawsuit by Robert A. Cantore (who argued this morning for plaintiffs), Joseph L. Paller Jr. and Robert Stock of Gilbert & Sackman, a law firm specializing in labor and employment law.

Defendants are represented by Lawrence J. Gartner (who argued for defendants), Naomi Young and Wendy E. Stanford of Baker & Hostetler.
